California Retailers Sue Texas To Allow Direct Shipping

Several California-based retailers have sued the State of Texas in an attempt to get the state to allow direct-to-consumer wine sales by out-of-state retailers.

The lawsuit, filed by Kenneth Starr of Kirkland & Ellis, follows in the footsteps of the landmark Granholm v. Heald decision on direct-to-consumer sales by wineries. Texas, which lost its own direct shipping case, subsequently passed legislation in 2005 that allowed wineries, but not retailers, to sell to Texas adult residents. The suit is supported by the newly formed Specialty Wine Retailers Association.
